In its submissions the Amicus Curiae will focus on whether the difference in the treatment of a person with a mental disability, where fitness for trial is in issue (as in the instant case), compared to the treatment of a person without a mental disability, might constitute discrimination under generally accepted human rights standards, as established by the European Convention on Human Rights, the International Covenant on Civil and Political Rights and the Convention on the Rights of Persons with a Disabilities
