The Irish Human Rights and Equality Commission (IHREC) today appears before the High Court as amicus curiae (friend of the Court) in the judicial review proceedings entitled P. v. The Chief Superintendent of the Garda National Immigration Bureau & Ors (2013/795/JR).
In this case, the Applicant is a Vietnamese woman who has been charged with certain criminal offences. However, she claims that she is a victim of trafficking connected with labour and that the failure of the Chief Superintendent to recognise her as a victim of trafficking means that she cannot avail of specialist assistance and support. She also claims that the process for the identification of victims of trafficking in Ireland is unfair and does not comply with the European Convention on Human Rights or the European Union law relating to trafficking in human beings.
IHREC is involved in this case to draw the attention of the court to the human rights standards that relate to trafficking in human beings as set out in the Constitution and the conventions of the United Nations and of the Council of Europe including the observations and proposals of the Council of Europe Group of Experts on Action against Trafficking in Human Beings (GRETA).
