Tithíocht agus Idirdhealú ar bhonn Míchumais

Tarlaíonn idirdhealú ar an bhforas míchumais nuair a dhéileáiltear le duine le níos lú fabhair ná mar a dhéileáiltear le duine eile, mar go bhfuil míchumas ar dhuine amháin agus nach bhfuil ar an duine eile, nó mar nach ionann an míchumas atá orthu.

Sainmhínítear ‘míchumas’ go leathan mar riochtaí fisiciúla, intleachtúla, foghlama, cognaíochta, mothúchánacha nó leighis.

Bunaíodh le cásdlí go n-áirítear leis an sainmhíniú, mar shampla, dúlagar, titimeas, uamhan clóis (clástrafóibe) agus uamhan sráide (agrafóibe), alcólachas, coilm ar an éadan, Neamhord Hipirghníomhaíochta an Easnaimh Airde (ADHD), ionfhabhtú VEID, diaibéiteas agus disléicse.

Is é an riail ghinearálta nach féidir idirdhealú a dhéanamh ar an bhforas míchumais maidir le:

  • aon eastát a dhiúscairt;
  • tionóntacht a fhoirceannadh;
  • cóiríocht, nó aon seirbhísí nó taitneamhachtaí a bhaineann le cóiríocht a sholáthar; nó
  • scor de chóiríocht a sholáthar.

Caithfidh an t-áitreabh nó an chóiríocht a bheith ar fáil don phobal i gcoitinne nó do chuid den phobal.

Céard a chuimsítear?

The Equal Status Acts 2000–2018:

  • promote equality;
  • prohibit certain kinds of discrimination (with some exemptions) across a number of specified grounds (Age, Civil Status, Disability, Family Status, Gender, Housing Assistance Payment; Membership of the Traveller Community, Race, Religion, Sexual Orientation);
  • prohibit sexual harassment and harassment across a number of specified grounds;
  • prohibit victimisation;
  • require reasonable accommodation of people with disabilities;
  • allow a broad range of positive action measures.

The Equal Status Acts also implement the following two EU Directives – the Race Directive and the Gender Goods and Services Directive.

There are several significant exemptions in the Equal Status Acts that apply to the provision housing and accommodation.

These exemptions should be read restrictively and should not be allowed to limit unduly the general prohibition on discrimination.
