The IHRC was today granted leave by the President of the High Court, to intervene as amicus curiae in the proceedings entitled Fleming v Ireland and the Attorney General. The Plaintiff in the proceedings is seeking to challenge the constitutionality of a provision of the criminal law, which makes it an offence to "aid, abet counsel or procure the suicide of another". The Plaintiff is a woman with progressive multiple sclerosis, and states that she wishes to be able to end her life with assistance at such time as she chooses. However, she claims that the current state of the law prevents her from doing so, thus breaching her human rights. The case will commence hearing on 4 December 2012 before a division of the High Court, and the IHRC will make its written submissions available after the case has been heard.
