Submission on the General Scheme of the Housing and Planning and Development Bill 2019

The Commission has a mandate to keep under review the adequacy and effectiveness of law and practice in the State relating to the
protection of human rights and equality and to examine any legislative proposal and report its views on any implications for human rights or, equality.

We have used this power in examining the General Scheme of the Housing and Planning and Development Bill 2019

The Commission considers that judicial review is an important accountability mechanism that encourages better administrative decision-making and provides an
opportunity for decisions of the State, its organs and its public bodies to be challenged. It is essential that access to justice is as broad as possible to allow the individuals, groups and communities who may be affected by decisions to bring judicial review proceedings, where relevant.
